&nbsp;Mit dem Inkrafttreten der europäischen MiCAR-Verordnung (EU-Verordnung 2023/1114) wurde die territoriale und materielle Zuständigkeit der Europäischen Union (EU) im Bereich Blockchain erheblich erweitert. Diese Regelung hat konkrete Auswirkungen auf die Schweiz: Von nun an müssen Unternehmen mit Sitz in der Schweiz in den meisten Fällen eine Niederlassung innerhalb der EU gründen, um legal tätig sein zu können. Dieser Ansatz ist sinnvoll, da eine direkte oder transponierte Anwendung von MiCAR in der Schweiz nicht wünschenswert erscheint. Das Land muss sich durch eine vorteilhafte Regulierung auszeichnen, die weltweit einzigartige Vorteile bietet, um wettbewerbsfähig zu bleiben.Am 22. Oktober 2025 hat der Bundesrat eine Vernehmlassung zur Änderung des Bundesgesetzes über die Finanzinstitute gestartet, mit der insbesondere die Vorschriften für Stablecoins verschärft werden sollen. Dieser Vorschlag kommt zu einem Zeitpunkt, zu dem keine Stablecoins von Bedeutung aus der Schweiz emittiert werden und ohne dass die Frage der Gleichwertigkeit mit dem europäischen System angesprochen wird.Letztendlich gibt die Verschärfung der Schweizer Regulierung gegenüber der Blockchain-Branche ohne Gleichwertigkeitsregelung Anlass zur Sorge. Unter diesen Umständen gäbe es praktisch keinen regulatorischen Vorteil mehr, ein Unternehmen in der Schweiz statt in der EU zu gründen.

&nbsp;With the entry into force of the European MiCAR Regulation (EU Regulation 2023/1114), the territorial and material jurisdiction of the European Union (EU) in the field of blockchain has been significantly expanded. This regulation has concrete implications for Switzerland: From now on, companies based in Switzerland must, in most cases, establish a branch within the EU to operate legally. Conversely, European companies generally have unrestricted access to the Swiss market.The European MiCAR Regulation provides for a principle of equivalence for third countries (Art. 140 para. 2 lit. v MiCAR), which has not yet been specified. The European Commission must submit a report on the necessity of introducing such a regulation by June 30, 2027.Switzerland has a flexible regulation that is adapted to the specifics of blockchain. This approach is sensible, as a direct or transposed application of MiCAR in Switzerland does not seem desirable. The country must distinguish itself through advantageous regulation that offers unique global benefits to remain competitive.On October 22, 2025, the Federal Council launched a consultation on the amendment of the Federal Act on Financial Institutions, which aims to tighten regulations for stablecoins in particular. This proposal comes at a time when no significant stablecoins are being issued from Switzerland and without addressing the issue of equivalence with the European system.Ultimately, the tightening of Swiss regulation towards the blockchain industry without an equivalence regulation is cause for concern. Under these circumstances, there would practically be no regulatory advantage to establishing a company in Switzerland instead of the EU.

Der Bundesrat hat, wie in der Begründung der Interpellation erwähnt, im Oktober 2025 die Vernehmlassung zur Änderung des Finanzinstitutsgesetzes (FINIG; SR 954.1) eröffnet. Ziel des Gesetzgebungsprojekts ist es, die Rahmenbedingungen für die Marktentwicklung, die Standortattraktivität sowie die Integration innovativer Finanztechnologien in das bestehende Finanzsystem zu verbessern und damit verbundene Risiken – insbesondere in Bezug auf Finanzstabilität, Integrität sowie den Anleger- und Kundenschutz – zu adressieren.Zu diesem Zweck sollen die «Fintech-Bewilligung» weiterentwickelt und ein verlässlicher Regulierungsrahmen für die Ausgabe von Stablecoins sowie für Dienstleistungen im Zusammenhang mit anderen Kryptowährungen geschaffen werden. Zudem sollen internationale Standards, namentlich jene des Financial Stability Board (FSB), umgesetzt werden. Dies soll den Ruf des Finanzplatzes Schweiz stärken und die Wettbewerbsfähigkeit seiner Akteure nachhaltig sichern, namentlich indem die vorgeschlagene Regulierung und Aufsicht in der Schweiz ihnen den Marktzutritt in andere Länder, etwa in die USA, ermöglichen kann.&nbsp;Die Vernehmlassung zum Regulierungsprojekt ist Anfang Februar 2026 zu Ende gegangen und wird zurzeit ausgewertet. Hierzu gehören auch die in der Interpellation aufgeworfenen Anliegen. Die Anpassungen an der Vorlage aufgrund der Vernehmlassung werden dem Parlament mit Verabschiedung der Botschaft vorgelegt. &nbsp;Der Bundesrat strebt weiterhin einen Regulierungsrahmen an, der die Attraktivität des Wirtschafts- und Finanzplatzes Schweiz für innovative und technologiegetriebene Geschäftsmodelle stärkt und die internationale Wettbewerbsfähigkeit langfristig sichert. Er wird zudem die Entwicklungen rund um die Verordnung der EU über Märkte für Kryptowerte (MiCA) weiterverfolgen und sich gegenüber der EU für einen möglichst ungehinderten Marktzugang einsetzen.

The Federal Council, as mentioned in the justification of the interpellation, opened the consultation on the amendment of the Financial Institutions Act (FINIG; SR 954.1) in October 2025. The aim of the legislative project is to improve the framework conditions for market development, location attractiveness, and the integration of innovative financial technologies into the existing financial system, and to address associated risks – particularly with regard to financial stability, integrity, and investor and customer protection.For this purpose, the "Fintech License" is to be further developed and a reliable regulatory framework for the issuance of stablecoins as well as for services related to other cryptocurrencies is to be created. In addition, international standards, namely those of the Financial Stability Board (FSB), are to be implemented. This is intended to strengthen the reputation of the Swiss financial center and sustainably secure the competitiveness of its players, particularly by enabling the proposed regulation and supervision in Switzerland to allow them market access to other countries, such as the USA.&nbsp;The consultation on the regulatory project ended at the beginning of February 2026 and is currently being evaluated. This also includes the concerns raised in the interpellation. The adjustments to the proposal due to the consultation will be presented to Parliament with the adoption of the message.&nbsp;The Federal Council continues to strive for a regulatory framework that strengthens the attractiveness of Switzerland as an economic and financial center for innovative and technology-driven business models and ensures international competitiveness in the long term. It will also continue to monitor developments around the EU regulation on markets for crypto-assets (MiCA) and advocate for the most unhindered market access possible with the EU.
