Mit dem Inkrafttreten der europäischen MiCAR-Verordnung (EU-Verordnung 2023/1114) wurde die territoriale und materielle Zuständigkeit der Europäischen Union (EU) im Bereich Blockchain erheblich erweitert. Diese Regelung hat konkrete Auswirkungen auf die Schweiz: Von nun an müssen Unternehmen mit Sitz in der Schweiz in den meisten Fällen eine Niederlassung innerhalb der EU gründen, um legal tätig sein zu können.

With the entry into force of the European MiCAR Regulation (EU Regulation 2023/1114), the territorial and material jurisdiction of the European Union (EU) in the field of blockchain has been significantly expanded. This regulation has concrete implications for Switzerland: From now on, companies based in Switzerland must, in most cases, establish a branch within the EU to operate legally.
