The Federal Council provides a balanced assessment of Bitcoin's legal status and its potential role in the Swiss National Bank's (SNB) monetary policy. While it acknowledges that Bitcoin is not explicitly included in the SNB's current investment framework, it leaves open the possibility for future inclusion based on the SNB's assessment of its suitability as an asset.

Zu 1: Die Finanzgeschäfte (Geschäfte mit Finanzmarktteilnehmern), welche die SNB zur Erfüllung ihrer geld- und währungspolitischen Aufgaben einsetzen darf, sind in Artikel 9 Absatz 1 des Nationalbankgesetzes (NBG; SR 951.11 ) aufgeführt. Darunter fällt unter anderem der Kauf und Verkauf von auf Schweizerfranken oder Fremdwährungen lautenden Forderungen und Effekten sowie Edelmetallen und Edelmetallforderungen auf den Finanzmärkten (Art. 9 Abs. 1 Bst. c NBG). Kryptowährungen wie Bitcoin sind in dieser Auflistung der Geschäfte weder erwähnt noch ausgeschlossen. Die Rechtsnatur von Kryptowährungen ist umstritten. Der Bundesrat ordnet die klassischen Kryptowährungen wie Bitcoin (anders etwa als Stablecoins) mangels eines Forderungsschuldners als faktische, immaterielle Vermögenswerte ein (Botschaft zum Bundesgesetz zur Anpassung des Bundesrechts an Entwicklungen der Technik verteilter elektronischer Register vom 27. November 2019, BBl 2020 233 ff., 242 f., 277). Auch in der Lehre wird diese Einordung verschiedentlich geteilt. Demzufolge liesse sich argumentieren, dass Bitcoins weder als Forderungen noch als Effekten oder Sachen zu qualifizieren sind und damit von Artikel 9 Absatz 1 Buchstabe c NBG nicht erfasst würden. Einer solchen Sicht ist allerdings entgegenzuhalten, dass der betreffende Artikel 9 NBG bewusst offen formuliert wurde, um der SNB einen grossen rechtsgeschäftlichen Handlungsspielraum zu ermöglichen, damit sie trotz der sich dynamisch wandelnden Finanzmärkte ihre Aufgaben optimal erfüllen kann (vgl. Botschaft über die Revision des Nationalbankgesetzes (NBG) vom 26. Juni 2002, BBl 2002 6097 ff., 6194). Das Halten neuer Arten von an den Finanzmärkten gehandelten Vermögenswerten wie Bitcoin wäre demnach nicht ausgeschlossen. Die Schranken für deren Erwerb ergeben sich in erster Linie daraus, dass die Nationalbank aufgrund ihrer Aufgaben spezifische Anforderungen an die Zusammensetzung ihrer Währungsreserven zu beachten hat [insbesondere bezüglich Liquidität, Risiko und Ertrag (vgl. Botschaft über die Revision des Nationalbankgesetzes vom 26. Juni 2002, BBl 2002 6097 ff., 6186)]. Sofern die SNB somit aufgrund autonomer Einschätzung zum Schluss kommt, dass der Erwerb von Bitcoin oder anderer Kryptowährungen zur Erfüllung der geld- und währungspolitischen Aufgaben dienlich ist und die entsprechenden Anforderungen an die Währungsreserven erfüllt sind, wäre dies unter geltendem Recht nicht ausgeschlossen. Die Eignung von Bitcoin als Aktivum zur Erfüllung der geld- und währungspolitischen Aufgaben wird von der SNB bislang verneint, wie sie verschiedentlich – unter anderem im Rahmen der allgemeinen Aussprache an den Generalversammlungen der letzten Jahre – ausgeführt hat. Die SNB argumentiert dabei insbesondere, dass Bitcoin wegen seiner relativ geringen Liquidität sowie seiner ausgeprägten Wertschwankungen nicht die Anforderungen an eine Anlageklasse der Währungsreserven der SNB erfülle. Falls sich diese Beurteilung der SNB künftig ändern würde, ist es aber – wie oben ausgeführt – nicht ausgeschlossen, dass sie im geltenden gesetzlichen Rahmen Kryptowährungen wie Bitcoin erwirbt. To 1: The financial transactions (transactions with financial market participants) that the SNB is permitted to use to fulfill its monetary and currency policy tasks are listed in Article 9, paragraph 1 of the National Bank Act (NBA; SR 951.11). This includes, among other things, the purchase and sale of claims and securities denominated in Swiss francs or foreign currencies, as well as precious metals and precious metal claims on the financial markets (Art. 9 para. 1 let. c NBA). Cryptocurrencies like Bitcoin are neither mentioned nor excluded in this list of transactions. The legal nature of cryptocurrencies is disputed. The Federal Council classifies traditional cryptocurrencies like Bitcoin (unlike, for example, stablecoins) as de facto intangible assets due to the lack of a debtor (Message on the Federal Act on the Adaptation of Federal Law to Developments in the Technology of Distributed Electronic Registers of November 27, 2019, BBl 2020 233 ff., 242 f., 277). This classification is also shared in various academic teachings. Consequently, it could be argued that Bitcoins are neither to be qualified as claims nor as securities or goods and thus would not be covered by Article 9, paragraph 1, letter c NBA. However, it should be noted that the relevant Article 9 NBA was deliberately formulated openly to provide the SNB with a wide scope of legal action, allowing it to optimally fulfill its tasks despite the dynamically changing financial markets (cf. Message on the Revision of the National Bank Act (NBA) of June 26, 2002, BBl 2002 6097 ff., 6194). Therefore, holding new types of assets traded on financial markets like Bitcoin would not be excluded. The limitations for their acquisition primarily arise from the fact that the National Bank, due to its tasks, must observe specific requirements regarding the composition of its currency reserves [particularly concerning liquidity, risk, and return (cf. Message on the Revision of the National Bank Act of June 26, 2002, BBl 2002 6097 ff., 6186)]. Thus, if the SNB autonomously concludes that acquiring Bitcoin or other cryptocurrencies is beneficial for fulfilling its monetary and currency policy tasks and the corresponding requirements for currency reserves are met, this would not be excluded under current law. The SNB has so far denied the suitability of Bitcoin as an asset for fulfilling monetary and currency policy tasks, as it has stated on various occasions, including during general discussions at the general meetings of recent years. The SNB argues, in particular, that Bitcoin does not meet the requirements for an asset class of the SNB's currency reserves due to its relatively low liquidity and pronounced value fluctuations. However, if this assessment by the SNB were to change in the future, it is not excluded, as stated above, that it could acquire cryptocurrencies like Bitcoin within the current legal framework. &lt;p&gt;Die Anfrage bezweckt, Klarheit über die rechtlichen Rahmenbedingungen der Schweizerischen Nationalbank (SNB) in Bezug auf neue und relevante Anlageklassen wie Bitcoin zu schaffen. Vorliegend wird die Autonomie der SNB in der Bestimmung ihrer Anlagepolitik nicht in Frage gestellt.&amp;nbsp;&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;Angesichts der wachsenden globalen Bedeutung von Kryptowährungen stellt sich die Frage, ob die gesetzlichen Grundlagen noch zeitgemäss sind und der SNB die notwendige Flexibilität gewähren, um im Interesse der Stabilität des Finanzsystems zu handeln. Die globale Marktkapitalisierung sämtlicher Anlageklassen beläuft sich nämlich gemäss Schätzungen von MSCI auf 270,7 Billionen US-Dollar. Gleichzeitig beträgt die Marktkapitalisierung von Bitcoin derzeit etwa 2,02 Billionen US-Dollar und stellt damit eine zunehmend relevante Anlageklasse dar.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;Gemäss Artikel 9 des Nationalbankgesetzes (NBG, SR 951.11) ist die SNB ermächtigt, zur Erfüllung ihrer geld- und währungspolitischen Aufgaben verschiedene Finanzgeschäfte zu tätigen. Dazu gehören der Kauf und Verkauf von Forderungen, Effekten sowie Edelmetallen (Art. 9 Abs. 1 lit. c). Es stellt sich jedoch die Frage, ob Bitcoin als Vermögenswert zur Deckung der Geldmenge unter die Bestimmungen des NBG fällt.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;Vor diesem Hintergrund wird der Bundesrat um die Beantwortung folgender Fragen gebeten.&lt;/p&gt;&lt;ol&gt;&lt;li&gt;Wäre die SNB nach aktuellem Stand des Artikels 9 NBG rechtlich ermächtigt, Bitcoin als Aktivum zur Deckung der Geldmenge zu erwerben, sofern sie dies autonom beschliessen würde?&lt;/li&gt;&lt;li&gt;Falls die Antwort auf Frage 1 negativ ausfällt:&lt;ol&gt;&lt;li&gt;Auf welchen gesetzlichen Grundlagen basiert die Beschränkung, Bitcoin nicht als Aktivum erwerben zu dürfen?&lt;/li&gt;&lt;li&gt;Welche gesetzlichen Anpassungen wären erforderlich, um es der SNB zu ermöglichen, Bitcoin im Einklang mit ihrem geldpolitischen Auftrag und unter Wahrung ihrer Autonomie als Vermögenswert zu kaufen?&lt;/li&gt;&lt;/ol&gt;&lt;/li&gt;&lt;/ol&gt;

&lt;p&gt;The inquiry aims to clarify the legal framework of the Swiss National Bank (SNB) concerning new and relevant asset classes such as Bitcoin. The autonomy of the SNB in determining its investment policy is not questioned here.&amp;nbsp;&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;In view of the growing global significance of cryptocurrencies, the question arises whether the legal foundations are still up-to-date and grant the SNB the necessary flexibility to act in the interest of the stability of the financial system. According to estimates by MSCI, the global market capitalization of all asset classes amounts to 270.7 trillion US dollars. At the same time, the market capitalization of Bitcoin currently amounts to approximately 2.02 trillion US dollars, thus representing an increasingly relevant asset class.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;According to Article 9 of the National Bank Act (NBA, SR 951.11), the SNB is authorized to conduct various financial transactions to fulfill its monetary and currency policy tasks. These include the purchase and sale of claims, securities, and precious metals (Art. 9 para. 1 lit. c). However, the question arises whether Bitcoin as an asset to cover the money supply falls under the provisions of the NBA.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;Against this background, the Federal Council is requested to answer the following questions.&lt;/p&gt;&lt;ol&gt;&lt;li&gt;Would the SNB, under the current status of Article 9 NBA, be legally authorized to acquire Bitcoin as an asset to cover the money supply, should it autonomously decide to do so?&lt;/li&gt;&lt;li&gt;If the answer to question 1 is negative:&lt;ol&gt;&lt;li&gt;On what legal grounds is the restriction based that prohibits acquiring Bitcoin as an asset?&lt;/li&gt;&lt;li&gt;What legal adjustments would be necessary to enable the SNB to purchase Bitcoin in line with its monetary policy mandate and while maintaining its autonomy as an asset?&lt;/li&gt;&lt;/ol&gt;&lt;/li&gt;&lt;/ol&gt;
